Terms of Service

These terms govern your use of the public MediBrave website and, where applicable, your MediBrave subscription.

Agreement and scope

MediBrave CMS is a software product operated by Digital Hive Hub, a sole proprietorship registered in Malaysia. By accessing or using the MediBrave website or a MediBrave subscription, you agree to be bound by these terms. If you do not agree, please do not use the service.

These terms apply to the public website at https://medibrave.com and to MediBrave subscriptions purchased for a clinic. They are supplemented by the Privacy Policy and the Billing, Cancellation & Refund Policy, which are incorporated by reference.

The service

MediBrave is clinic operations software for Malaysian private clinics, covering appointment, patient record, consultation, pharmacy, billing, reporting, and related workflows. The website provides information, demos, and pre-sales engagement. Subscription access is provided through the MediBrave application for an authorised clinic.

Accounts and responsibilities

If a clinic account is created, the account owner is responsible for keeping access credentials secure, controlling who may use the account, and ensuring that account information is accurate. You must notify MediBrave promptly of any unauthorised access or suspected misuse.

Subscriptions, plans, and availability

MediBrave offers Lite and Pro subscriptions at the published prices on this website and Enterprise on a custom, quotation-based basis. Plan features, limits, and availability may change from time to time in accordance with these terms. Features described as future, provider-dependent, or implementation-pending are not guaranteed to be available.

Trials

Lite and Pro offer a 14-day free trial with no credit card required and no automatic conversion to a paid subscription. A trial is limited to one per clinic or business. Enterprise does not use a self-service trial.

Automatic renewal and notices

Monthly and annual subscriptions renew automatically until cancelled. Annual customers receive a renewal reminder at least 30 days before the next charge. Monthly-plan price changes require at least 30 days’ notice. An annual-plan price remains unchanged through the paid term; any change requires at least 30 days’ notice before the affected renewal.

Fair use and acceptable use

You must not misuse the service, attempt to interfere with its operation or security, bypass limits or quotas, submit unlawful content, or use the service in a way that harms other customers or the availability of the service. MediBrave may apply documented quotas, rate limits, security controls, suppression controls, and anti-abuse measures to usage-based services and may restrict activity that presents a security threat or abuse risk.

Provider-dependent features

Certain features depend on external providers and operational activation. WhatsApp reminder eligibility is available to Pro and Enterprise clinics after manual activation and is subject to provider availability, consent, opt-out, fair use, and abuse controls. The e-Invoicing capability is described as an e-Invoicing foundation and does not guarantee regulatory acceptance. Artificial-intelligence assistance is not currently advertised as an included feature; if and when activated, it is assistive and subject to the AI limitations below.

Support boundaries

Standard support is available through email and WhatsApp on Malaysian business days from 9:00 AM to 6:00 PM MYT. MediBrave aims to respond within one business day as a service target, not a contractual SLA. Support does not include clinic administration, data entry, repeated staff training, custom reports, hardware repair, or clinical advice. Enterprise priority support is described in the applicable quotation.

Migration and onboarding

One standard migration is included after a clinic becomes a paying Lite or Pro customer, covering data supported by MediBrave’s standard import templates with one initial import and one reasonable correction pass. Duplicate cleanup, damaged files, unusual mapping, multiple source systems, attachment migration, and custom migration are separately scoped and quoted. Enterprise migration is always assessed and quoted.

Storage and attachments

Lite includes 10 GB and Pro includes 50 GB of attachment-storage per clinic; Enterprise storage is custom-scoped. Existing files remain accessible when a quota is reached, while new uploads stop until space is released or additional storage is purchased. Additional storage is available in 50 GB blocks at RM24/month per block for Lite and Pro.

Cancellation and termination

Monthly and annual subscriptions may be cancelled at any time to stop the next renewal and remain active until the end of the paid term. There is no cancellation fee. Cancellation must be straightforward and available through the product billing flow. MediBrave may suspend or terminate access for material breach of these terms, abuse, or security risk. Cancellation of a subscription is separate from deletion of clinic data.

Post-subscription access and data deletion

Subscription access continues through the end of the paid term. Clinics should use available export and download tools while their subscription is active. After a subscription ends, access is governed by these terms and applicable law; MediBrave may provide reasonable export assistance upon request, subject to technical feasibility and mutually agreed scope. Clinic data is retained and deleted in accordance with the Privacy Policy and applicable legal, regulatory, dispute, fraud, and security-preservation duties.

Export availability and limitations

MediBrave provides tools for clinics to export or download supported clinic data and documents in commonly used formats. Available export types, formats, and coverage may vary according to the data, feature, subscription status, and technical capabilities available at the time. Where available tools do not meet a clinic’s reasonable requirements, MediBrave may offer additional export assistance subject to technical feasibility, security requirements, mutually agreed scope, and applicable fees. Unless expressly agreed in writing, MediBrave does not guarantee compatibility with another software provider, direct transfer into another system, or reconstruction of the clinic’s complete environment within a third-party product. MediBrave does not commit to providing specific export formats or capabilities in the future.

Enterprise written terms

Enterprise access is provided under a written quotation or order form that states scope, fees, implementation, support, retention, and export variations. Expressly agreed Enterprise commercial terms may prevail over these standard terms, but cannot override statutory rights or privacy-law duties.

No medical advice

MediBrave is clinic operations software. Content on this website and output from the application is informational and operational only and does not provide medical advice, diagnosis, treatment, or regulatory certification. Clinics remain responsible for professional judgement and patient care.

AI limitations

If and when artificial-intelligence assistance is activated, output is assistive, probabilistic, and clinician-reviewed. It must not be used to autonomously diagnose or prescribe and does not replace professional judgement. You are responsible for verifying any such output before use.

Third-party services

MediBrave uses third-party providers for hosting, database, email delivery, payments, attachment storage, and analytics. Their own terms and privacy policies apply to their processing.

Intellectual property

The MediBrave name, branding, website design, software, and related materials remain the property of their respective owner or operator unless otherwise stated. You receive a limited right to use the service for your clinic operations and must not copy, modify, or redistribute MediBrave software without permission.

Warranty and availability limitations

The website and service are provided on an “as is” and “as available” basis. MediBrave does not warrant uninterrupted operation, error-free performance, or that every feature will be available at all times. MediBrave does not guarantee daily backups, numeric uptime, or a Lite/Pro service level agreement.

Limitation of liability

To the maximum extent permitted by law, MediBrave is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or service. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, liability is limited to the maximum extent permitted by law and these limitations may not apply to you. Nothing in these terms limits rights that cannot be limited under applicable law.

Changes

MediBrave may update these terms from time to time. Material changes will be posted with a new “last updated” date. Your continued use of the website or service after changes are posted constitutes acceptance of the revised terms.

Governing law and contact

These terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. Questions about these terms can be sent to [email protected].
